Pre-sentencing Report

 

Notes: I will not attempt to point out all of the mistakes at this time, but they will all be pointed out at a later date.

 

The last paragraph is misleading. DHS determined the bruises to be the result of abuse, but the authorities determined them to be accidental.

Notes: On this page you start to see the bias in the report. If this officer wrote the report from official documents, she would know the date that Kathie was awarded guardianship. The officer completely skipped over the part about DHS removing Kelsey from Kathie's home because Kathie and Lance were suspects in the abuse. She completely skips over the part about Kelsey's legs being broken while at Kathie's home and makes it sound like both legs were broken at the zoo. That's untrue.

 

This is the first report I've heard of Kathie saying Kelsey was medicated on that August visit. The only times that there were witnesses to Kelsey being medicated were while Kelsey was with Kathie.

 

In my opinion, Kathie may as well have written this report for the officer. It's obviously directly from her and not official documentation.

Notes: When Kelsey said "Daddy Mike hurt my head," Kelsey was in DHS custody and Raye Dawn and Mike only had supervised visits. At that time, Kelsey hadn't seen Mike and Kathie had just been with Kelsey. Raye Dawn knew Kelsey hadn't seen Mike and she thought that Kathie had coached Kelsey to take the focus off herself because of Kelsey's legs being broken at Kathie's home.  When Kelsey reportedly made the comment about her feet, Kathie was the one who "heard" that.

Notes: Kelsey did not bite while with the Smiths. Kathie acts like Kelsey bit everyone and everything, maybe she did while with the Briggs, but she was not a biter with the Smiths. She did, however, self-mutilate by picking her toenails, scabs, and skin. She loved to pick at things.

 

If Kathie thought Kelsey would be dead, why didn't she appeal the decision? Everyone at that hearing had a right, but Kathie decided to quit Kelsey and not even show up for supervised visitation because DHS talked bad about her. If that were my grandchild, I would have been there for every visit and not spent all my time on the phone like Kathie was reprimanded about and I would have shown up for every hearing, unlike Kathie.

Notes: If the Briggs wanted justice for Kelsey, why befriend the man who sexually assaulted and murdered her and let him get off without a trial and go into a cushy prison under protection?

Notes: How could the custody battle over Kelsey contribute to Lance and Ashley's divorce? Is it because Kathie was trying to get custody for Ashley all along and when she lost both of them quit Kelsey? Raye Dawn said almost every time she would drop Kelsey off with Kathie, instead of Kathie heading toward her home when she left, she headed straight to Lance and Ashley's.

Notes: We're not blaming Raye Dawn's drug usage on Lance, but if she had not been married to a drug addict who has been in rehab five times and grew his own pot then maybe she would have never tried them. Raye Dawn was an adult and could make her own decisions, but she was also in an abusive relationship where Lance would punch her and give her black eyes and caused her to miscarry her first child as a result of that abuse. It's not like she was married to a normal person and she started using drugs on her own. She was a battered wife.

Notes: Smith denies culpability because she's not responsible for the actions of the manipulative and deceitful man she married. Raye Dawn thought Kelsey would be safe once she was away from the Briggs. There were five agencies visiting Kelsey daily and they didn't see the abuse either. How was an untrained person who had only seen the abuse from Lance supposed to see abuse that was hidden? The only one in that home that saw was Mike Porter's daughter. Nobody else saw, so how could Raye Dawn?
